Eligibility & Selection of Winners:

To be eligible all orders must be received by European Touch no later than December 31, 2008, with the final random drawing to be held between Jan 1 – Jan 10, 2009. Each order will result in one entry into the contest. European Touch is not responsible for entries not received before drawing deadline. Salon owners can enter without purchase by going to the Clean Touch page on www.EuropeanTouch.com and completing an entry from. One entry per salon. Must be a salon owner, licensed nail technician, licensed esthetician, or licensed cosmetologist to enter. Names will be drawn randomly and prizes awarded starting with first prize and working downward to third prize winners. Winners will be announced no later than January 15, 2009. First and second prize winners and guests will be required to sign a legal disclaimer prior to prize award.

*First and Second Prize Winners:

Cruise winners must choose pre-selected cruise packages based on the prize awarded. Each cruise includes accommodations for the cruise winner and one guest, based on (1) one cabin / double occupancy. Cruise package includes shipboard accommodations, ocean transportation, on-board included meals, port charges and government taxes and fees. Transportation to and from the port of departure is the sole responsibility of the winner. Charges of a personal nature, including, but not limited to, airport to port transportation, fuel surcharges, gratuities, phone calls, shore excursions, gift shop purchases, spas, etc., are the sole responsibility of the winner. All other expenses not specifically referred to herein shall also be the responsibility of winners.

Winners and guest are also solely responsible for meeting any and all requisite governmental requirements, including, but not limited to, possessing a valid passport (for travel outside the USA). First and second place winners must be 18 years of age or older. The winning entrants and guests will be required to supply Social Security numbers or other taxpayer identification numbers prior to the award of prizes. All taxes on the prize, including but not limited to income and sales taxes, are the responsibility of the prize winner.

All travel must be booked through selected cruise officials at least 60 days in advance of the cruise or additional costs may apply. All travel is subject to space availability. Blackout dates including holidays and other restrictions may apply. Travel must be completed by July 30, 2009.

Third Place Winners

All winners will be contacted by European Touch and shipped the corresponding prize no later than February 1, 2009.

Other Important Points

Contest participants, by entering, release European Touch from any liability with respect to the receipt or use of awarded prizes and agree to be bound by the Prize Contest Official Rules. European Touch makes no, and disclaims, all warranties, guarantees or representations, express or implied, concerning the condition or quality of awarded prizes.

Salon owners may enter without purchase by visiting the official contest at wwww.EuropeanTouch.com, and reading the Clean Touch information, and completing an entry form. One entry per salon, limited to salon owners, licensed cosmetologists or licensed nail technicians.

Prizes:

Prizes are non-transferable, non-substitutable and have no cash value.

Odds of Winning:

Odds of winning depend on the number of eligible entries received.

Disclaimer and Limit of Liability:

European Touch makes no representations or warranties of any kind, express or implied, regarding any prize or entrant’s participation in any contest. European Touch shall not be responsible or liable for any loss, damage, cost or injury that arises from or relates to participation in the contest or use of a prize. European Touch reserves the right, in its sole discretion and without prior notice, to suspend or cancel any contest or alter the rules for any reason.

Release:

By entering the contest, each entrant; indemnifies, releases and agrees to hold harmless European Touch and its owners, distributor executing the order from any liability whatsoever for any claims, costs, losses, or damages of any kind (including, but not limited to) those related to, personal injury, death, damage or loss of property.

Governing Law:

This contest shall be governed by and construed in accordance with the laws of the State of Wisconsin, applicable to contracts made and performed therein without reference to conflicts of law principles. All actions, proceedings, or litigation relating hereto will be instituted and prosecuted solely within the State of Wisconsin, county of Milwaukee. The parties consent to the jurisdiction of the federal and state courts located in the State of Wisconsin, County of Milwaukee, with respect to any action, dispute, or other matter pertaining to or arising out of the contest.
